1. Acceptance of Terms

By accessing smartnutritioncare.com, submitting a form, or purchasing any program, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our services. Smart Nutrition Care LLC ("Smart Nutrition Care," "we," "us") may update these terms; the current version will always be posted on this page.

2. Description of Services

Smart Nutrition Care provides online nutrition planning, wellness coaching, and weight-loss management programs, including personalized meal frameworks, 1:1 coaching sessions, progress tracking, and educational content. Services are delivered virtually to clients located in the United States. Specific deliverables for each program tier are described on our pricing page.

3. Not Medical Advice

Important: Smart Nutrition Care provides nutrition and wellness education and coaching. We are not a medical clinic, and our services do not constitute medical diagnosis, treatment, or prescription. Always consult your physician or qualified healthcare provider before beginning any nutrition or weight-loss program — especially if you are pregnant, nursing, taking medication (including insulin or blood-pressure medication), or managing a medical condition. Never discontinue or alter prescribed treatment based on coaching advice.

4. Eligibility

Our services are available to individuals aged 18 or older residing in the United States. By purchasing, you confirm you meet these requirements and that the information you provide is truthful and complete to the best of your knowledge.

5. Bookings, Sessions & Rescheduling

Coaching sessions are scheduled by mutual agreement and conducted by video or phone.
You may reschedule a session with at least 24 hours' notice at no charge. Sessions missed without notice may be forfeited.
Sessions expire 60 days after their scheduled date if unused, unless a pause is arranged.

6. Billing, Subscriptions & Cancellation

Membership plans bill monthly in advance to your payment method on file.
No contracts: you may pause or cancel at any time; cancellation stops future billing. Access continues through the end of the paid period.
14-day guarantee: new memberships may be cancelled within 14 days of first payment for a full refund.
Refunds beyond the 14-day guarantee are at our sole discretion. Failed payments may pause service until resolved.

7. Results Disclaimer

Testimonials and examples on our website reflect real client experiences but are not a guarantee of your results. Individual outcomes vary based on adherence, health status, and circumstances beyond our control. We make no warranty of any specific weight, health, or fitness outcome.

8. Acceptable Use

You agree not to: misuse the website or app; scrape, reproduce, or resell our content; impersonate others; submit false information; upload malicious code; or use our services in violation of applicable law. We may suspend accounts that violate these rules.

9. Intellectual Property

All website content, meal-plan frameworks, curricula, recipes, graphics, logos, and materials are the property of Smart Nutrition Care LLC and protected by U.S. copyright and trademark law. You receive a personal, non-transferable license to use materials for your own participation. Redistribution or commercial use is prohibited.

10. Third-Party Links & Tools

Our site and coaching may reference third-party websites, apps, or products. We do not control and are not responsible for third-party content, policies, or availability.

11. Limitation of Liability

To the maximum extent permitted by law, Smart Nutrition Care LLC, its owners, coaches, and staff shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total aggregate liability for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Smart Nutrition Care LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these terms or your misuse of our services.

13. Dispute Resolution & Governing Law

These terms are governed by the laws of the State of Iowa, USA, without regard to conflict-of-law principles. Disputes shall first be addressed through good-faith negotiation; unresolved disputes shall be brought in the state or federal courts located in Dubuque County, Iowa.

14. Communication Consent

By submitting a form or purchasing a program, you consent to receive service-related communications by email, phone, or message. Marketing emails may be declined anytime via our unsubscribe page.

15. Severability & Entire Agreement

If any provision of these terms is found unenforceable, the remaining provisions continue in full force. These terms, together with the Privacy Policy, constitute the entire agreement between you and Smart Nutrition Care regarding our services.
